Buying or selling a car, boat, or camper in Maine? A common question is whether the title or bill of sale needs to be notarized. Here's the honest answer, even though it may mean you don't need us at all.
Maine Titles: Usually No Notary
For a typical private sale of a Maine-titled vehicle, the seller assigns the title to the buyer by signing and completing the transfer section. Maine's title-transfer statute (29-A MRSA §662) describes an assignment and warranty of title with odometer information, and it doesn't mention notarization. If your title has no notary block, you probably don't need one.
Check with the Maine Bureau of Motor Vehicles or your municipal registration office if you're unsure. Requirements can change, and special situations exist.
When a Notary *Might* Be Needed
Out-of-State Titles
Some states require notarization on their title assignments or on related forms. If you're buying a car titled in another state, or selling a vehicle that will be registered elsewhere, read the title carefully. A notary block on the title is a strong hint.
Odometer, Lien, and Lost-Title Forms
Certain affidavits, such as those for lost titles, lien releases, or odometer discrepancies, may require a sworn signature. These are usually jurats.
Powers of Attorney
If someone is signing on behalf of an owner, the agency or dealer may want a notarized power of attorney.
Estates
Transferring a vehicle from a deceased owner's estate often involves affidavits or court documents that need notarization.
Bills of Sale
Maine bills of sale typically don't require notarization, but some buyers, lenders, or other states' agencies prefer one. If the other party or the receiving agency asks for it, we're happy to help.
